DEA-Oleth-3 Phosphate is listed in EU Annex II (reference II/411) of Regulation 1223/2009, which prohibits diethanolamine (DEA) and its compounds in cosmetic products intended to remain on the skin for extended periods. DEA-derived ingredients can react with nitrosating agents to form N-nitrosodiethanolamine (NDELA), a suspected carcinogen. This restriction significantly limits its use in leave-on cosmetic formulations in the EU.
