These Terms of Service ("Terms") are a legal agreement between you and Bogdan Tudor, an individual developer based in Romania, operating as LuxSense ("LuxSense," "we," "us," or "our"). LuxSense is not yet incorporated as a legal entity.
By downloading, installing, or using the LuxSense application or website (together, the "Service"), you agree to be bound by these Terms in their entirety, including all disclaimers and limitations of liability. If you don't agree, please don't use the Service.
These Terms apply in addition to our Privacy Policy and Open Source Licenses, which are incorporated by reference.
LuxSense is a skincare ingredient analysis tool. Understanding how it works is essential to understanding its limitations:

Pregnancy safety flags in LuxSense are informational only, based on general published data. They are not comprehensive, not medical advice, and not a substitute for consultation with your healthcare provider. If you are pregnant, planning to become pregnant, or breastfeeding, consult your healthcare provider before using any skincare product.
For any skin concerns, allergic reactions, or medical conditions, consult a qualified dermatologist or healthcare provider. Do not delay seeking medical advice because of anything you read in LuxSense.
Product identification is performed by AI (Anthropic's Claude). AI can misidentify products, provide incorrect ingredient lists, or produce results with varying confidence levels. Even "high confidence" identifications can be wrong.
Ingredient lists come from web searches and retailer pages, which may be incomplete, inaccurate, represent different product variants, or be outdated. Web-sourced data is not sourced from the physical product label you hold — there is no guarantee it matches your specific product.
Safety data comes from the EU CosIng Database (European Commission), PubChem (U.S. NIH), and Open Beauty Facts (community-contributed, ODbL). We do not independently verify the accuracy of these sources.
Our scoring algorithm is proprietary and uses general category-level assessments. It does not consider ingredient concentrations, formulation context, pH, individual factors, or interactions between ingredients. Scores may change as our algorithm is updated.
As part of ingredient verification, our servers may automatically fetch publicly available web pages from retailer and brand websites. Fetched content is processed in real-time to extract ingredient lists and immediately discarded. We do not store, cache, or redistribute fetched content.
You must be at least 16 years old to use LuxSense. By using the Service, you represent that you meet this requirement.

The LuxSense app, website, brand, scoring algorithm, and original content are owned by Bogdan Tudor and protected by copyright and intellectual property law. Our database incorporates open data (CosIng, PubChem, Open Beauty Facts) under their original licenses — see Licenses.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including:
No information provided by LuxSense creates any warranty not expressly stated in these Terms.
LUXSENSE SHALL NOT BE LIABLE FOR ANY: adverse skin reactions, allergic responses, health consequences, injury, illness, or death related to the use of any product, regardless of any information, score, analysis, warning, or absence of warning provided by the Service.
This includes liability for: incomplete or inaccurate ingredient lists, incorrectly identified products, pregnancy or breastfeeding-related harm, and reliance on varying scan results.
We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, profits, or goodwill. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim. As the Service is currently free, this cap is €0 (zero euros).
By using the Service, you acknowledge that:
Nothing in these Terms excludes liability that cannot be excluded under applicable law. EU consumers retain their mandatory statutory rights. These Terms do not exclude liability for fraud, wilful misconduct, or gross negligence where such exclusion is prohibited by law.
You agree to indemnify and hold harmless Bogdan Tudor (operating as LuxSense) from any claims, damages, losses, or expenses arising from: your use of the Service, your reliance on information from the Service, your violation of these Terms, or any claim related to your use of any product identified or analyzed by the Service.
By you: Stop using LuxSense at any time by deleting the app.
By us: We may suspend or discontinue the Service at any time.
Survival: Disclaimers, limitation of liability, indemnification, and governing law sections survive termination.
These Terms are governed by the laws of Romania, without regard to conflict-of-law principles.
Dispute resolution: Contact us first at [email protected]. If unresolved within 30 days, disputes may be pursued through courts in Bucharest, Romania.
EU consumers: Your statutory rights under your country's consumer protection laws are not affected. You may also use the EU Online Dispute Resolution platform.
We may update these Terms. For material changes, we'll provide at least 30 days' notice. Continued use after changes take effect constitutes acceptance.
